False accusations of domestic violence are not uncommon. In many cases, accusations are brought forward during a divorce by a spouse to gain leverage for spousal support or child custody. These are serious accusations and can lead to criminal charges. This exact scenario happened to one of our clients recently.

Our client had been physically, emotionally and verbally abused by his wife throughout their marriage. She used these methods to scare and control our client, which ultimately led to him filing for divorce. Knowing that he would file for divorce, she filed a police report accusing him of domestic violence to give her leverage for future child custody of their young son. The actual incident involved her again being physically abusive toward our client with him defending himself. However, the police still moved forward with criminal charges against our client. Domestic Violence convictions can lead to significant fines and even jail time. We worked with the Prosecuting Attorney to have the charge reduced to Disorderly Conduct with a diversionary sentence. He was ultimately sentenced to 6 months of non-reporting probation. As long as he does not violate the terms of probation, his record will remain clean with no convictions.
